Court nullifies APC Taraba guber primary, orders fresh election

The All Progressives Congress gubernatorial primary held in Taraba has been nullified by a Federal High Court in Jalingo on Tuesday.

The primary, which produced Senator Emmanuel Bwacha as the candidate of the party for the 2023 general election, was nullified after one of the aspirants filed a law suit, challenging the authenticity of the election.

The aspirant, David Sabo Kente on May 26 sued the Independent National Electoral Commission (INEC), Senator Emmanuel Bwacha and APC as the first, second and third defendants respectively.

The presiding judge, Justice Simon Amobeda,  following substantive evidence nullified the election and ordered a fresh primary election to be conducted by the party within 14 days while the mode of the election should be determined within seven days.

Justice Amobeda said “No APC governorship primary election was held in Taraba. Therefore, the nomination of the second defendant (Bwacha) as the governorship candidate did not comply with the electoral act of 2022,”

“The third defendant shall within 14 days conduct a fresh election and shall determine the mode of primaries within seven days of the judgement.”
