El-Rufai sues ICPC, alleges unlawful raid, demands N1bn damages

Former Kaduna State Governor, Nasir El-Rufai, has filed a N1 billion fundamental rights enforcement suit against the Independent Corrupt Practices and Other Related Offences Commission (ICPC), challenging the legality of a search conducted at his Abuja residence and accusing the agency of violating his constitutional rights.

El-Rufai, in the suit before the Federal High Court, Abuja, is specifically contesting the February 19, 2026, search of his residence at No. 12 Mambilla Street, Aso Drive, conducted by ICPC operatives alongside police officers.

Through his lawyer, Oluwole Iyamu, the former governor argued that the search warrant issued earlier on February 4 by a Chief Magistrate Court in the Federal Capital Territory was “invalid, null and void,” citing “lack of particularity, material drafting errors, ambiguity, overbreadth, and absence of probable cause.”

He asked the court to declare the operation unconstitutional and a violation of his rights to privacy, dignity, personal liberty, and fair hearing.

“El-Rufai is seeking an order awarding the sum of N1, 000,000,000 as general, exemplary, and aggravated damages… for trespass, unlawful seizure, psychological trauma, humiliation, distress, infringement of privacy, and reputational harm,” the court filing stated.

He also asked the court to order the immediate return of all items seized during the search and to bar authorities from relying on any materials obtained from the operation in any investigation or prosecution.

The former governor further demanded N100 million as the cost of filing the suit.

He named the ICPC, the Chief Magistrate of the FCT, the Inspector-General of Police, and the Attorney-General of the Federation as respondents.

Iyamu argued that the warrant violated provisions of the Administration of Criminal Justice Act (ACJA), 2015, insisting it was not backed by sworn evidence establishing reasonable grounds for suspicion.

As of press time, the ICPC and other respondents had not filed responses to the suit.

The court is yet to fix a date for the hearing.
