
A 46-year-old man, Sunday Ogenyi, who allegedly defrauded a tyre dealer of N884,000, was on Thursday arraigned before an Ogudu Magistrates’ Court in Lagos State.
Ogenyi, whose address was not provided, pleaded not guilty when the two-count charge of fraud and stealing was read to him.
The prosecutor, Insp Donjiur Perezi, told the court that the defendant committed the offences sometime between Nov. 26, 2018, and June 17, 2019, at Ogudu GRA, Ojota, Lagos.
Perezi alleged that the defendant sold six tyres of a Scania truck, which he had collected from the complainant, Mr Christopher Ogbuchukwu, on the promise he would remit the money after he sold the tyres.
According to him, the defendant sold the six tyres at the cost of N884, 000, but failed to remit the proceeds from the sale to the complainant.
The prosecutor told the court that the defendant instead converted the money to his personal use.
The prosecutor said the offences contravened Sections 314 and 287 of the Criminal Law of Lagos State, 2015.
Section 287 stipulates three years jail term for stealing for any convicted offender.
The defendant pleaded not guilty to the charges.
The Magistrate, Mrs O.M Ajayi granted the defendant bail in the sum of N50,000 with two sureties in like sum.
Ajayi said one of the sureties must be a blood relation while the other must reside within the court’s jurisdiction with evidence of tax payments to the Lagos State Government.
The magistrate adjourned the case to April 13, for mention. (NAN)
