Man drags Anambra CP, DCP, others to court, seeks enforcement of fundamental rights

The Chief Executive Officer (CEO) of Blue Shield Security Company Limited in Anambra State, Ozo Jeff Nweke has dragged Anambra State Commissioner of Police, CP Aderemi Adeoye, Deputy Commissioner of Police, DCP Akin Fakorede and Inspector Monday Umuna of the state police command to the Federal High Court in Awka to seek for enforcement of his fundamental human rights.

Ozo Jeff Nweke said in an originating summon under order 2 rule 3 of the fundamental rights ( enforcement procedure) rule 2009, the police invasion of his property at Agunaogu land of Ezinano Community, Awka also known as four corner court estate Awka, was a breach of his fundamental rights.

In suit number FHC /AWK/CS/280/2023 he sought the following reliefs; the invasion of his parcel of land located at Four Corner Court estate on the 28th day of September 2023 by the respondents to force him out of the land was a clear violation of his rights to acquire and own property in Nigeria as guaranteed by the constitution.

He stated that the continued forceful occupation of his parcel of land by the respondents through their armed agents was a clear breach of his rights.
That continued inhibition against him from entering his parcel of land at the Four Corner court estate Awka by the respondents through their agents completely violates his rights.

He also made a claim of N20 million from the respondents as general damages for the breach of his fundamental rights.

He further sought the order of the court to grant a perpetual order restraining the respondents from further breach of his fundamental rights to acquire land in Nigeria.

The plaintiff said that he is seeking relief on the ground that “every Nigerian according to section 46 of the Constitution of the Federal Republic of Nigeria,1999 as amended who alleges that any provision of chapter 4 of the constitution has been, is being or is likely to be contravened in any state in relation may apply to High Court in the state for redress.

“That by the virtue of section 43 of the 1999 constitution of the Federal Republic of Nigeria, every citizen of Nigeria, including him is entitled to fundamental rights to acquire and own immovable property anywhere in Nigeria.

He said that no citizen of Nigeria shall be without any legal justification forced out of his personal property.

He further averred that respondents have forcefully entered his portion of land where he is building his residential house.

He claimed that the respondents and agents have warded off every effort to enter his land where there is ongoing development and had threatened to arrest and detain him if he forced himself into the land.

According to him, he is making the claims in the interest of justice and prayed that his prayers be granted
