
The People Democratic Party has taken the Chairman, All Progressives Congress (APC) Caretaker and Extra-ordinary Convention Planning Committee (CECPC), Governor Mai Mala Buni to a Federal High Court in Abuja seeking his removal from office as the Governor as of Yobe State.
The PDP in the suit marked FHC/ABJ/CS/885/2021 asked the court to make the governor defend whether or not he ceased to be governor by accepting to be the Caretaker Committee Chairman of the All Progressives Congress (APC).
The PDP in the suit dated August 12 and filed by Emeka Etiaba, SAN alleged that Buni violated section 183 of the constitution when as a governor he accepted to serve as Chairman of the Caretaker Committee of the All Progressives Congress (APC).
The plaintiffs which include Umar Damagum and Baba Aji, insisted that Buni ceases to be a governor from the moment he accepted to act as APC Caretaker Committee Chairman.

The plaintiffs therefore asked the court for an order directing the Yobe State Chief Judge or any other senior person next to the Chief Judge to immediately swear in Damagum and Aji as Governor and Deputy Governor of Yobe State being candidates of the party which came second in the 2019 governorship election in Yobe State.

But the APC in a statement reacting to the suit said that suit is misplaced and frivolous because it will be sub judice and that the party is obviously executing a desperate and poorly-scripted propaganda plot
Our attention has been drawn to a purported court action sponsored by the Peoples Democratic Party (PDP) against His Excellency, Mai Mala Buni, Chairman of the APC Caretaker/Extraordinary Convention Planning Committee (CECPC) and Governor of Yobe State.
While we are constrained from and reluctant to comment on the PDP’s misplaced and frivolous court action because it will be sub judice, the PDP leadership is obviously executing a desperate and poorly-scripted propaganda plot aimed at deflecting attention from the crisis of confidence the failed opposition party faces.
The PDP is an ignominious rabble-rouser and has no locus to take any action on the internal affairs of the APC.
The Supreme Court has already affirmed the status and legality of the CECPC and that is all there is to it.
There are clearly spelled out punitive measures against abuse of court processes. We are confident that the Judiciary will apply these measures fully.
