The bill to amend Labour Act 2004 by reviewing labour fines upwards to provide protection for workers in the labour market has passed the Second Reading in the Senate.
Presenting the lead debate on the Labour Act Amendment Bill 2021, Senator Ezenwa Francis Onyewuchi, sponsor of the bill, said the bill will bring in line with modern realities the obsolete fines for offenses in the present Labour Act.
“The present fines for offences in the Nigerian Labour Act are obsolete in context and content. The sanctions, penalty and interest payable under the Act are under ridiculously low and do not reflect current economic realities. The current provisions cannot provide the needed protection for workers in the labour market. There is therefore a need to review these penalties/fines upwards in order to achieve fair and harmonious employee relations,” he stated.
The bill proposed among others that breach of terms and conditions of employment as it relates to wage hour, nature of employment, leave and contracts of employment, which attracts between N800 for first offence at present and N1500 for second or subsequent offences, will attract N500,000 to one million Naira.
APC to review constitution ahead of 2023 poll
No fewer than eleven clauses in the Labour Act Cap L1, LFN, 2004, have been proposed for a review under the bill, which the Senate President, Ahmad Lawan, has referred to the Senate Committee on Labour to report back within four weeks.
