Alleged Organ Harvest: Victim request court to not avail bio-data to Ekweremadu

David Ukpo, the alleged kidney donor to the daughter of Senator Ike Ekweremadu and wife Beatrice Ekweremadu in the alleged organ harvesting situation, has requested that the order by the court which has permitted his bio-data to be released to the Ekweremadus be reversed

The Federal High Court in Abuja, on the 1st of July, ordered that Ukpo’s bio-data be released to the embattled senator and wife for use in a London court where they are facing trial.

Ukpo, in an application filed through his team of lawyers led by Bamidele Igbenedion, faulted the proceedings that gave the order for the release of his bio-data, stating that his fundamental rights to fair hearing and personal privacy had been violated

He added that neither he nor the Attorney General of the Federation, AGF, were made a party in the suit.

“The attorney-general of the federation was also not made a party to the suit to enable the interest of the Federal Government to be represented, seeing that the effect of the order was to be utilized in a foreign country, namely the United Kingdom

“The applicant became aware of the said ruling through social media reports on Facebook and the applicant was deeply aggrieved with the said order(s).

It is in the interest of justice to set aside the entire proceedings

“Unless the matter is heard urgently, irreparable damage and serious mischief would have been done to the applicant as the 1st and 2nd applicants/respondents would have taken undue advantage to take the Applicant’s bio-data and other personal information to their own use in Uxbridge Magistrate Court in the UK.” He said

Defendants in the motion bothering on the alleged breach of fundamental rights are National Identity Management Commission, NIMC, Comptroller General, Nigeria Immigration Service, Stanbic IBTC Bank, United Bank for Africa (UBA) and Nigeria Inter-bank Settlement System.

The applicant is praying the court to restrain the defendants, their agents, privies, staff, and workers from releasing any information concerning him to Ekweremadu and his wife for their defense in the London court.

September 13 was fixed for hearing in the matter
