No secret clause to dump criminals in Nigeria- Tunji-Ojo, Interior Minister

Minister of Interior, Olubunmi Tunji-Ojo, has defended the Nigeria–United Kingdom migration agreement, dismissing claims that the country would serve as a dumping ground for criminals. He said the Memorandum of Understanding (MoU) is based on reciprocity, respect for human rights, and cooperation on irregular migration. Tunji-Ojo spoke on Channels Television’s Politics Today, monitored by David Lawani.
Many Nigerians have expressed concern about the migration agreement between Nigeria and the United Kingdom. While the government believes the deal is beneficial, critics argue that Nigeria may be conceding too much. What does the agreement mean for the average Nigerian?
Governance is built on trust, and the President does not take lightly the confidence Nigerians reposed in him through the electoral process. Every decision taken by this administration is guided strictly by national interest and the need to protect the dignity of Nigerians. This agreement is based on the internationally recognised principle of reciprocity, which ensures that both countries are treated equally and fairly. Nigerians should not see this as a concession but rather as an opportunity to collaborate in addressing irregular migration, which has become a global challenge affecting many countries, including Nigeria. We are committed to addressing our domestic challenges while working responsibly with international partners. Irregular migration has implications for national security, economic planning and social stability. It is linked to crimes such as human trafficking and smuggling of migrants. Therefore, international cooperation is essential to tackle these issues effectively. This agreement sets out a clear framework for collaboration and ensures we follow proper procedures for managing migration-related matters.
Some Nigerians believe the details of the agreement are not fully known to the public. Has the government published the document?
The document has not been formally published as a single public booklet, but the provisions are not hidden. The Special Adviser to the President on Information and Strategy, Bayo Onanuga, issued a public statement outlining key aspects of the agreement, and the contents have been widely reported in the media. There is no attempt by the government to conceal any part of the agreement. Transparency remains important to this administration, and Nigerians should rely on verified information rather than speculation. The agreement’s essential elements clearly show that the focus is on regulated migration and cooperation between the two countries.
What exactly is the scope of the Memorandum of Understanding between Nigeria and the United Kingdom?
The MoU establishes a framework to facilitate safe, orderly, and regular migration between Nigeria and the United Kingdom. It also strengthens bilateral cooperation in tackling irregular migration and associated crimes such as human trafficking and migrant smuggling. Both countries are guided by their respective constitutions and international legal obligations. Nigeria is also affected by migration challenges, including visa overstayers from various countries. Thousands of foreign nationals remain in Nigeria beyond the validity of their permits. This demonstrates that migration management is not a one-sided responsibility. Cooperation helps both countries address these issues more effectively through information sharing and coordinated procedures. Addressing irregular migration also contributes to tackling related crimes. When proper migration processes are followed, it reduces the risk of exploitation and abuse of vulnerable persons.
There appears to be confusion regarding overstayers. Are the figures being mentioned global statistics or specific to Nigeria?
The figures relate to overstayers within Nigeria alone. Citizens of different countries sometimes remain in Nigeria beyond the permitted duration of their visas, creating administrative and legal challenges. This shows that migration issues affect many countries, not only the United Kingdom. By strengthening cooperation with international partners, Nigeria can improve compliance with immigration regulations and ensure orderly migration processes. Effective migration management benefits both host countries and migrants themselves.
Some reports suggest that the agreement could allow foreign prisoners to be transferred to Nigeria. Is this accurate?
That interpretation is incorrect. The agreement does not provide any basis for Nigeria to accept foreign prisoners indiscriminately. This government will never allow Nigeria to become a dumping ground for criminals. The agreement focuses strictly on Nigerian nationals who may have overstayed or lost their legal immigration status in the United Kingdom. Every sovereign country has the obligation to receive its citizens when immigration issues arise abroad. However, such processes must follow proper identification procedures and comply with domestic and international laws. The agreement emphasises dignity and respect for fundamental human rights.
Is the agreement legally binding, and how does the cooperation framework operate?
The MoU is a cooperation framework based on mutual respect and reciprocity. It outlines procedures for confirming nationality before initiating any return process. Immigration authorities must verify that an individual is indeed a citizen of the country concerned. The Nigeria Immigration Service plays an important role in coordinating return processes in accordance with Nigerian laws. Travel arrangements must also be communicated in advance to ensure proper coordination. These procedures ensure that no individual is returned arbitrarily or without due process. Many of the concerns expressed publicly arise from incomplete information. Those who study the provisions carefully will see that the agreement protects national interest.
Do you believe the United Kingdom could pressure Nigeria into accepting unfavourable conditions?
Nigeria is a sovereign nation and will not accept any arrangement that undermines its national interest. The President is committed to ensuring that Nigeria engages with its international partners based on equality and mutual respect. Diplomatic agreements are carefully negotiated, and Nigeria actively participates in shaping their terms. The suggestion that Nigeria would accept unfavourable conditions does not reflect the reality of international diplomacy. Our national interest remains paramount.
What led to the renewal or expansion of this agreement?
The earlier framework dates back to 2022, and the current agreement expands cooperation on migration management. Nigeria retains full control over documentation and travel processes involving its citizens. The responsibility for issuing travel documents remains exclusively with Nigerian authorities. Comparisons with agreements involving other countries are inaccurate because bilateral arrangements differ depending on national priorities. Each agreement is negotiated to reflect the interests of the parties involved.
Why do you think many Nigerians remain sceptical about the agreement?
Migration is a sensitive issue globally, and Nigerians understandably want clarity about agreements that affect them. However, some concerns arise from misinformation and political interpretations that do not reflect the MoU’s actual provisions. The agreement is based on established international principles and does not involve accepting asylum seekers from the United Kingdom. Its focus is on migration cooperation, documentation processes and dignified return procedures. We will continue to engage with the public and provide clarification as needed.
To clarify, Nigeria is not accepting foreign criminals under this arrangement?
That is correct. The agreement does not contain any provision for the transfer of foreign criminals into Nigeria. It applies only to Nigerian nationals who may be out of immigration status in the United Kingdom. Government remains committed to protecting the dignity and rights of Nigerians wherever they may be. The agreement reinforces those protections rather than undermining them.
Does the agreement impose any liability on Nigeria?
No undue liability is imposed on Nigeria. This is a balanced bilateral arrangement that ensures both countries fulfil their responsibilities in accordance with international practice. Nigeria’s sovereignty remains intact at all times. The agreement reflects shared responsibility in addressing migration challenges and does not create unequal obligations.
What specific benefits will Nigeria derive from the agreement?
One important benefit is the protection of the dignity and rights of Nigerian citizens abroad. In the past, deportation processes sometimes occurred without adequate consideration for the welfare of affected individuals. Some persons returned without their belongings or without sufficient time to prepare for reintegration. The agreement ensures that returnees are treated fairly and without discrimination. Individuals will have the opportunity to organise their affairs before returning home, including arrangements regarding personal assets. This promotes humane and orderly migration processes. In addition, cooperation between both countries helps address irregular migration and related crimes, which benefits society as a whole.
Does reciprocity mean both countries enjoy equal rights and responsibilities?
Yes, reciprocity ensures balance and fairness. Similar obligations under the agreement bind both Nigeria and the United Kingdom. Citizens of both countries are entitled to equal treatment under the MoU. Equal rights and responsibilities are fundamental principles guiding the agreement.
How does the agreement affect Nigerians who may have assets abroad?
The agreement allows returnees to make arrangements regarding their assets before departure. Individuals can transfer or dispose of property in accordance with applicable laws. This ensures that migration processes do not lead to unnecessary financial loss or hardship. Such provisions reflect respect for dignity and fairness in the treatment of migrants.
What happens in cases involving convicted criminals?
Applicable laws and court decisions determine criminal matters. A Memorandum of Understanding cannot override the judgment of a competent court of jurisdiction. Individuals convicted of criminal offences are subject to legal processes applicable in the country where the offence occurred. The agreement primarily addresses immigration status rather than criminal liability.
What assurances can you give Nigerians about the agreement’s long-term implications?
Nigerians should remain confident that the government will always protect national interests. Every agreement entered into by this administration undergoes careful review to ensure it is consistent with our laws and values. Nigeria will continue to engage constructively with international partners while safeguarding the dignity of its citizens. The agreement represents an opportunity to strengthen migration management systems and ensure fair treatment of Nigerians abroad.
